Arroyave filed his response on November 8 and rejected the demands of the "Real Housewives of Beverly Hills" alum. Arroyave requested joint physical and legal custody of the pair's minor children as opposed to his estranged wife's demand for primary and legal custody with supervised visitation.

The estranged couple share three children, Slate, 12, Cruz, 10, and Dove, 4, and it is still unclear what the court will settle for. Arroyave also asked that Mellencamp pay him spousal support, and the court terminated their ability to award her with any financial support.

He noted that their prenup provides that: "the parties' Premarital Agreement sets forth the terms regarding the amount and duration of spousal support to be paid."
