The Menéndez brothers, Lyle and Erik, whose shocking conviction in 1990 for the murders of their parents captivated the nation, are once again in the spotlight as Los Angeles County prosecutors have recommended a resentencing for the infamous 1989 killings at the family’s Beverly Hills home.

The decision, unveiled by District Attorney George Gascón during a press conference on Thursday, October 24, opens a potential pathway to freedom for the brothers after 34 years in prison. Gascón’s announcement signals a re-evaluation of the Menéndez brothers’ prolonged incarceration, as well as the possibility of parole for the first time since their life sentences were handed down.

Now, over three decades later, recent developments in the case suggest a potential resentencing, bringing new hope for the Menéndez brothers and their families. Erik’s wife reacted to the news with a mix of emotion, highlighting the long journey that Erik has endured behind bars.

“Yesterday was a difficult and emotional day,” Tammi wrote via X, the social media platform formerly known as Twitter, on Friday, October 25, after Los Angeles District Attorney George Gascón recommended that Erik and brother Lyle Menéndez’s sentences be reduced to 50 years.

“I am grateful to DA Gascón for his courage to seek resentencing for Erik," she added. "I am naturally disappointed he did not go further and act on his own belief that Erik and Lyle have served enough time in prison."

The case dates back to August 20, 1989, when 18-year-old Erik and his 21-year-old brother, Lyle, shot and killed their parents at their family home in Beverly Hills. Using shotguns they had purchased just days earlier, the brothers carried out a brutal attack that captivated national attention and led to a series of trials.

Prosecutors argued that Erik and Lyle committed the murders to inherit their parents’ wealth, presenting them as motivated by financial gain. Meanwhile, the defense painted a different picture, claiming that the brothers acted in self-defense after enduring years of sexual abuse from their father, which, they said, culminated in fear for their lives.

The initial trial, held in 1994, ended in a mistrial after two separate juries could not reach a unanimous decision on whether the Menéndez brothers had acted in self-defense. The brothers had testified extensively, describing their abusive upbringing and alleging that their father had threatened to kill them to keep the family’s secrets from surfacing.

This deadlock led to a second trial, which ended with both Erik and Lyle convicted of first-degree murder and sentenced to life in prison without the possibility of parole.

“Not having sex in my life is difficult, but it’s not a problem for me,” Tammi shared with PEOPLE in 2005. “I have to be emotionally attached, and I’m emotionally attached to Erik.”

On Thursday, Los Angeles District Attorney George Gascón announced a significant development in the Menéndez brothers' case: Los Angeles County prosecutors are recommending that Erik and Lyle be resentenced. Now that Gascón has submitted his decision recommending resentencing, the ultimate decision rests with a judge, who will determine whether Erik Menéndez and Lyle Menéndez could be eligible for release on parole.
