Nikki Garcia finally takes the plunge and officially moves to end her marriage to Artem Chigvintsev!
The former pro wrestler officially filed for divorce from the dancer after her search for an attorney days after he was detained for alleged domestic violence.
Artem Chigvintsev was charged with felony corporal injury to spouse or cohabitant for allegedly attacking Nikki Garcia during a violent exchange at their home.
Nikki Garcia Wants Out Of Artem Chigvintsev's Marriage
The retired wrestler reportedly raced to court in the early hours of today to submit her filing and put an end to the marriage.
The move comes a week after word got out that she was looking for a divorce attorney a day after Chigvintsev's arrest. She finally found solace in Evan Craig Itzkowitz, who will now take up her cause.
The estranged couple were together for two years and shared a 4-year-old son, Matteo. It is still unclear if they had a prenup in place when they tied the knot.
Garcia's filing does not come as a surprise, as TMZ earlier reported that the mom-of-one ditched her wedding ring shortly after her estranged partner's arrest.
The estranged pair are also staying apart. Garcia is reportedly back at the family home in Napa Valley with their son, and the "DWTS" star is staying at a friend's place.
Inside Garcia And Chigvintsev's Heated Exchange
The 42-year-old was taken in following a 911 request for medical assistance for an alleged victim. The Blast detailed that Chigvintsev claimed he got into an argument with his wife, and she threw shoes at him.
According to information from a radio dispatch audio, Chigvintsev called and abruptly canceled his emergency service request. However, the police still showed up at the residence and confirmed a child was on the scene.
Local authorities claimed they discovered obvious injuries on the victim's body and then arrested the "DWTS" pro dancer for the felony. He posed for a viral mug shot during his arrest but was released on bail later.
Garcia's Appearance Amid Her Partner's Arrest
The former wrestler was seemingly unbothered about her estranged husband's arrest. She was spotted boarding a private plane with a female friend around the time Chigvintsev's mug shot went viral.
Garcia was pictured smiling with her wedding band missing as she hopped on board, which angered spectators on the internet who bashed her. Some fans speculated she was the aggressive one as no injuries were seen on her when she boarded the plane.
But they did not all condemn her; the 40-year-old won some internet users on her side who implored her critiques not to take domestic violence with levity. They expressed their optimism to get the necessary help as she deals with the issue.
The Estranged Duo Marked Their Second Wedding Anniversary Days Before The Incident
Garcia and Chigvintsev did not hint to the public about the turbulence in their marriage as they celebrated two years together as a couple three days before Chigvintsev's arrest.
The retired wrestler celebrated the milestone on her Instagram with a reel of their favorite romantic moments. She added lyrics to Haley Reinhart's cover of Elvis Presley's "Can't Help Falling in Love" hit song to the caption, which read:
"This song is our love story. I'll never forget where I was when I asked Jesus about Artem. Having a conversation with He & God. How my feelings felt too soon. It all felt too fast."
She concluded, writing, "And then this song came on. And that's when I knew that I was falling in love with him and that it was all meant to be."
Artem Chigvintsev's Case Was Transferred To The District Attorney's Office
While Chigvintsev is currently out on bail, the Napa County Sheriff has transferred his case to the Napa County District Attorney.
The Blast reported that the office was still reviewing the details of his case and that no official decision had been made on his charges.
Carlos Villatoro shared that the D.A.'s office still needs to examine witness statements, view footage from the incident, and check images that may have been taken or any other significant evidence the police found on the scene.
According to their spokesperson, the D.A. will arrive at a final decision only after all this is done and issue a public statement on their next step.
Artem Chigvintsev's arraignment is scheduled for November 4, but he now needs to add divorce proceedings to his plate!
