Kim Zolciak’s Daughter Ariana Biermann Follows Through On Fighting 2022 DUI Charges

Kim Zolciak's daughter, Ariana Biermann, is putting her money where her mouth is regarding her 2022 DUI case.
The 22-year-old demanded that the court shelf the evidence the prosecutors may want to use against her, insisting that it was obtained illegally.
Kim Zolciak's daughter had earlier pleaded not guilty to the six counts of misdemeanor brought against her and demanded a jury trial to resolve the case.
Kim Zolciak's Daughter's Lawyers Are Contesting The Evidence Gathered During Her Arrest
The 22-year-old was arrested on August 13, 2022, at a traffic stop initiated by a Forsyth County Sheriff's Department.
Ariana's lawyers claimed that the facts gathered at the time of her initial detention did not do enough to support the allegation that Ariana was under the influence of alcohol or drugs or "that any other criminal activity was underfoot."
Her lawyers noted that the 22-year-old did not violate any traffic laws before her arrest by local authorities.
"[Ariana] further shows that this initial detention was an unlawful warrantless seizure, not supported by probable cause or articulable suspicion, violating [Ariana's] rights under the Fourth Amendment to the Constitution of the United States," her lawyers added.
In Touch shared that the reality star also requested the dismissal of any evidence from the field sobriety tests, noting that the officer in charge may not have been qualified for the job.

The 22-year-old got into hot water with the State of Georgia for her reckless driving and bagged six charges. The charges include driving under the influence of multiple substances and driving under the influence of alcohol.
Also included is possession of drug-related objects due to her "unlawfully possessing a vape pen with THC cartridge, improper turn, failure to obey signs or control devices and underage possession of alcohol."
She was initially detained on charges of driving under the influence, misdemeanor improper lane change, and underage alcohol possession after she hit another vehicle.

Ariana's conduct on the scene of the incident may have rubbed off wrong on the authorities. The police, in their report, claimed she lied about drinking before getting behind the wheel despite the strong smell of alcohol on her.
However, the authorities noted that she admitted to smoking a THC vape pen the night before the arrest but would not confess to the alcohol accusation.
The reality star was arrested alongside her boyfriend, Hudson McLeroy. Her attorney immediately issued a statement about the arrest.
"Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI."
Justin Spizmand continued that despite his client's insistence "that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol."
He declared that his client denied the DUI allegations and would fight the charges to establish her innocence.

McLeroy's presence in the passenger's seat on the night of the DUI arrest was not shocking as the pair have been an item for years now.
The Blast noted that Ariana and her beau began their love story in 2018 as high schoolers and made it official on Instagram before her 17th birthday.
The duo also gained Zolciak's approval as she dropped a warm comment under the image. The reality star wrote:
"Where does the time go?? My angel @arianabiermann is headed to Homecoming with @hudson.mcleroy. Are they not the cutest!!?! They are only a few hours apart and will both turn 17 this week!!"
However, the relationship is said to be on and off, but with his arrest on the scene, it seemed they were still waxing strong.
Kim Zolciak's Other Daughter Was Also Slammed With An Accident Lawsuit
Ariana was not the only member of the clan in trouble over their automobile habits. Last month, The Blast reported that her sister, Brielle Biermann, was named in a lawsuit for causing a car owner to crash their car.
The plaintiff, Phillip Gibson, claimed Brielle's car appeared in front of him at a turning point in Georgia on July 5, causing him to swerve and run onto "the roundabout center median."
He noted that he damaged his left rear wheel and tire while trying to avoid crashing into Brielle. Gibson then demanded $750 in compensation for the damages to his car.
Like her baby sister, Brielle denied her involvement in the accident. Sources close to her also corroborated her story and explained that she left Georgia on July 3, which meant the chances of her causing an accident in absentia were very slim.
It remains unsure whether the police's evidence will be admitted in Ariana Biermann's case!
