Halle Berry's recent court battle didn't go as she had hoped!

The actress was not granted her request against her ex-husband, Olivier Martinez, in relation to their co-parenting situation.

Halle Berry and Olivier Martinez finalized their divorce in 2023, but the actress is back in court with claims that her ex-husband was skipping important therapy sessions.

Berry's request for an emergency court order demanding her ex-husband resume co-parenting therapy sessions was thrown out by a Los Angeles superior court judge.

According to court documents, the actress stated that Martinez had violated their agreement to embark on co-parenting therapy for the sake of their 10-year-old son Maceo.

Berry continued that the 58-year-old decided to miss out on summer sessions without the therapist's approval. 

Despite Martinez's promise to resume in September, Berry tried to convince the court to force him to attend, claiming that they were supposed to have completed six sessions by July 14.

"Olivier's conduct harms the parties' son, Maceo, causes further damage to the parties' already strained relationship, and forces [Halle] to incur unnecessary attorney's fees to constantly seek relief from the Court," her lawyers added.

In Touch shared that the actress has tried to resolve the issues directly with her ex-husband without involving lawyers, but to no avail.

"Olivier refused my efforts. My lawyer, Marina Beck, tried to resolve these issues directly with Olivier's now third lawyer for weeks but her efforts were ignored and later refused," Berry wrote in her statement.

Martinez's Legal Team Fired Back, Accusing Berry Of Harassment

Martinez's legal team argued that the issue between the ex-couple did not need an emergency hearing. They accused Berry of maliciously bringing the emergency motion when she knew Martinez was unreachable and miles away on vacation. The lawyers stated:

"[Halle] knowingly noticed her ex parte request when she knew Olivier] would be traveling and would be unable to communicate with his counsel to respond to [Halle's] ex parte request, thus further impeding [Olivier's] right to be heard."

The team continued that Berry constantly attempts to "harass and strong-arm" Martinez by forcing him into submission using her wealth and access to top lawyers.

The lawyers declared that she has also refused to agree to provide a fee contribution towards Martinez's legal fees, which has distorted the idea of a level playing ground.

Berry's luck maxed out as the judge ruled that the matter was not an emergency and instructed the actress to file a regular motion to deal with the issue at hand.

The order concluded, "[Halle's] ex parte relief is denied. There are no exigent circumstances as defined under the code. A regularly noticed request may be filed."

About three days before her request was denied, The Blast reported that the actress slammed Martinez for choosing vacation over their co-parenting sessions. She described him as selfish and uncooperative towards all her efforts to ensure a smooth co-parenting process.

She noted that his attitude was not good for the parties involved, nor was it beneficial for their son, as it caused "further damage to the parties' already strained relationship."

The actress had reportedly tried her best to develop a healthy co-parenting relationship with Martinez but was always met with "resistance and conflict. Berry also condemned his nonchalant behavior towards the whole process, adding that:

"To him, the terms of the parties' stipulated court orders are simply suggestions to follow when it benefits him and which he ignores when it does not fit his alienation agenda."

Martinez and Berry initially agreed to embark on co-parenting therapy/coaching sessions for the son's benefit, with Dr. Jaye-Jo Portanova as their therapist.

Portanova was employed to help the estranged couple resolve disputes and conflicts between them "in an effort to successfully co-parent the parties' minor child, Macro Robert Martinez ("Maceo"), in a manner that promotes Maceo's best interest."

The estranged couple agreed to attend individual sessions with Dr. Portanova before commencing the joint co-parenting therapy/coaching.

Berry and Martinez were then ordered to participate in no less than six joint sessions that must be completed by June 14.

The deadline seemingly expired, influencing Berry's decision to head to court.

The Ex-Couple's Relationship History

Things started on a very exciting note for Berry and Martinez, who debuted as an iconic duo in Hollywood a month after meeting on the "Dark Tides" set in July 2010.

Their romance lasted two years, and Martinez proposed in 2012. In July 2013, they married in a classy ceremony at Chateau des Conde, Vallery, France.

Martinez and Berry welcomed their only child, Maceo, in October of the same year, and that was the beginning of their marital woes.

Divorce rumors began brewing in March 2014, and by August 2015, the actress was spotted without her wedding ring.

"We move forward with love and respect for one another and the shared focus of what is best for our son," declared the duo as they filed for divorce in October 2015, blaming irreconcilable differences.
