According to new reports, Doherty gained a posthumous victory in her divorce case when a family law judge stepped up to end her marriage to Iswarienko.

The law in California and most states states that once someone embroiled in a divorce proceeding dies, the family law court loses jurisdiction over the case.

Instead, the responsibility is passed over to the probate court. Since probate judges do not finalize divorces, Doherty's case should have ended with her dying as a married woman.

However, TMZ revealed that the family law judge presiding over her case had signed the divorce papers, and the divorce judgment had been posthumously entered.

Following Doherty's claims, Iswarienko addressed the situation through his attorney, Katherine Heersema. He noted that he had showcased his desire to end their divorce by proposing a settlement in October 2023.

"Kurt is not 'simply wait[ing] for Shannen to die. He wants the best for Shannen, and he wants both of them to be able to put this case behind them and move forward," Heersema stressed.

The attorney implied Doherty was the culprit behind the delay, noting she refused her ex-husband's settlement. However, the actress argued that the agreement failed to address Iswarienko's "original works created during marriage" and his "earning capacity."
