Shannen Doherty is not backing down from her fight to receive spousal support from her estranged husband, Kurt Iswarienko.
The "Charmed" actress recently called out the photographer in new court documents, accusing him of shrinking from his duties amid her battle with terminal cancer. Meanwhile, her partner vehemently denied the allegation of "waiting for her to die."
Shannen Doherty's divorce from Kurt Iswarienko has been contentious, to say the least, with infidelity accusations and spousal support drama.
Shannen Doherty Claims Estranged Husband Is Intentionally Prolonging Their Divorce
The legal drama between the estranged couple reached new heights when Doherty claimed Iswarienko was biding his time in hopes she would die soon. She stressed that she had yet to receive a response to multiple requests for his financial information.
Doherty asked for information about Iswarienko's "archive" of original photography work, which would influence their divorce proceedings. However, she claimed her ex was delaying the process while her health progressively declined from terminal cancer.
"It is simply not right that Kurt be permitted to prolong our divorce in hopes that I die before he is required to pay me while he continues to live his life and shirk his responsibilities to his dying wife of more than 11 years," the actress argued in the documents obtained by PEOPLE.
Kurt Iswarienko Claims His Estranged Wife Prolonged Their Divorce Proceedings
Following Doherty's latest filing, Iswarienko's attorney, Katherine Heersema, denied the allegations of intentionally prolonging the divorce proceedings. Instead, the photographer's legal turned the blame on the actress, saying:
"Kurt is not 'simply wait[ing] for Shannen to die.' He wants the best for Shannen, and he wants both of them to be able to put this case behind them and move forward."
The attorney noted that Iswarienko tried to speed up their separation by offering Doherty a settlement deal in October 2023; however, she rejected it.
In her defense, the 53-year-old claimed the agreement "skirted around the issues of his original works created during marriage" and "his earning capacity."
The 'Beverly Hills, 90210' Alum Wants Over $15,000 In Spousal Support
As for Doherty's demands, she requested that Iswarienko cough up $15,434 in monthly spousal support due to her declining earnings. She explained that her SAG health insurance would no longer cater to her needs because she could not work.
The TV personality noted that Iswarienko could meet her demands, sharing documented calculations showing his average annual income over the past three years was $672,916.
This left "at least" $56,076 per month spendable, of which Doherty's lawyers stated the spousal support could be paid from.
Meanwhile, Doherty's calculations showed her average annual income as $259,708, including her work in 2021 and 2022, residuals, and health insurance.
As for recent years, the 53-year-old claimed she made slightly over $25,000, showing a significant drop in her income.
Shannen Doherty Accused Iswarienko Of Lavish Spending
In her documents, Doherty also accused Iswarienko of lavish spending. She claimed he enjoyed an extravagant lifestyle while she had zero access to funds, their marital vacation home in Texas, and even their private plane.
"Kurt has been utilizing the airplane, spending thousands of dollars at medical spas, jewelry stores, Gucci, and on flights… while simultaneously claiming he has insufficient funds with which to support me," the 53-year-old lamented.
Her words contradicted Iswarienko's argument of insufficient funds in his counter-request against Doherty's move to schedule their divorce case for trial. The photographer claimed he wanted a settlement instead of a legal battle.
Doherty's Former Beau Aired His Disinterest In A Divorce Trial
Earlier in June, The Blast obtained court documents that showcased Iswarienko's disinterest in pursuing a court trial. Through his lawyers, the photographer stressed that he wanted to finalize his differences with Doherty with a divorce settlement.
Iswarienko implored the court not to set a date to address their issues, countering Doherty's initial plea to schedule their divorce case for trial. The duo's problems included the dissolution of their marriage, spousal support, division of property, attorney fees, and more.
"This case is not yet ready for trial. In an effort to save attorney's fees and costs for both parties, Respondent has been focusing his efforts on settlement and has not yet conducted discovery," the actress's soon-to-be ex-husband argued.
Additionally, Iswarienko's reps claimed he lacked sufficient funds and information to "retain a forensic accountant or any other experts." On that note, he asked the court to hold their case until he could identify other issues after conducting a proper discovery with the necessary experts.
