Film producer Joel Silver wants his kids left out of the lawsuit brought by the family of his former personal assistant, who was found dead in Bora Bora while attending Jennifer Aniston’s honeymoon party.
According to court documents obtained by The Blast, Silver is asking a judge to prevent the late personal assistant’s family from trying to question his minor kids as part of the case.
Silver says the family of Carmel Musgrove recently fired off subpoenas to various people who were on the trip to Bora Bora when Musgrove was found dead in a lagoon.
He said the family even included his minor kids, Samuel Silver and Maxwell Silver, demanding they sit for depositions where they would answer questions under oath.
Silver says his kids were only “10 and 13 at the time of the drowning”, believing they would have nothing to offer the family.

The producer again calls the lawsuit “truly frivolous” and a “shake-down lawsuit.” He says the attempt to drag his kids into the case is harassment and only to try and make him settle.
He is pleading with a judge to shut down the depositions of his kids and has offered himself and his wife to testify. A judge has yet to rule.

Back in 2017, Silver was sued for wrongful death by the family of his late personal assistant Carmel Musgrove.
The suit claimed back in August 2015, Silver and 28-year-old Musgrove – along with the producer’s personal chef Martin Herold - flew out to the Four Seasons Hotel in Bora Bora to celebrate Jennifer Aniston and Justin Theroux’s honeymoon party.
The family said Musgrove and Herold partied together one-night drinking heavily and using cocaine and marijuana. Musgrove went missing and her naked body would be found on August 19th, 2015, floating in a lagoon near the hotel. Local authorities determined she drowned due to overconsumption of alcohol, consumption of cocaine, fatigue and heat stroke

The suit accused Silver or his team of not only overworking her, but being the ones who supplied Musgrove with cocaine and alcohol.
Musgrove’s family sued Silver accusing him of contributing to her death and sought unspecified damages.
Silver fired back at the allegations he played a role in his assistant’s death. The producer denied all allegations of wrongdoing in relation to Musgrove.
Silver claims Musgrove’s own negligence was the sole and proximate cause of her death. He says her actions lead to her death and nothing he did.
The producer argued Musgrove did not exercise ordinary care on her own behalf in Bora Bora.
The case is ongoing.
