Cher's Request To Become Son Elijah's Conservator Denied For A Second Time

Legendary singer Cher's request for conservatorship of her second son, Elijah Blue Allman, has been denied again.
During a hearing on the case, a judge sided with Elijah, noting that there was not enough evidence to prove that he needed to be in a conservatorship.
This is the second time Cher's request has been denied, as she was previously told off by the court for not correctly serving her son papers before the January 5 hearing of the case.
Cher Denied Conservatorship Of Elijah Blue Allman For A Second Time
On Monday, January 29, both mother and son were present for the hearing, although Cher appeared virtually.
During the hearing, Judge Jessica A. Uzcategui denied the "Believe" singer's request, stating, "I don't question the motivation behind Cher wanting to [help] her son... however, I do not see sufficient evidence."
Elijah's trust fund will be distributed to him on February 1, and in her court filings, his mother has expressed grave concern about his ability to manage his finances.
Cher previously alleged that "that if such distribution [of funds] were to be made directly to Elijah, such fund will be immediately spent on drugs, leaving Elijah with no assets to provide for himself and putting his life at risk."
In the latest court hearing, Cher's lawyers brought up the point again, saying that Elijah "is surrounded by people that deny the mental illness... we are trying to avoid a situation where his life is at risk."
Following the judge's latest ruling, Elijah's lawyers released a statement noting that he "is thrilled that the court saw he does not need a temporary conservatorship." They also said that the 47-year-old is open to mediation with his mother.
Cher Previously Denied An Emergency Conservatorship
Following a January 5 hearing, Judge Uzcategui denied Cher's request for immediate conservatorship of Elijah, noting that Cher's attorneys had not provided her son and his legal team with the required paperwork to provide them enough time to present their case.
Elijah himself had stated in a court filing obtained by The Blast that he was not properly served papers, which would have given him and his attorneys enough time to prepare for the first hearing of his conservatorship.
He noted that although he received an e-mail about a petition, he disregarded it as he was unsure of the sender's address. Elijah also claimed that even if he had accepted the e-mail service, the time it was sent was already too close to the date of his court hearing.
"While I did receive an e-mail copy of some petition and related documents on December 31, 2023, even if I had accepted service by e-mail that was not five court days before the hearing, and I have yet to receive or review the Confidential Supplemental Information that has been filed by [Cher]," a court document filed by Elijah read.
Elijah Blue Allman Claims He Is Clean And Doesn't Need His Mother's 'Unsolicited' Support
In his court filing, Elijah, a musician himself, stated that he was aware of his mother's good intentions for him but emphasized that he did not need her support.
Elijah noted that he has been "clean and sober from illicit substances for over 90 days now and [is] fully capable of and committed to managing the money [he] receives quarterly from the trust left by [his] late father."
He added, per court documents: "While I understand that my mother, the proposed conservator, believes she is looking out for my best interests, and I appreciate her love and support, I do not need her unsolicited help or support at this time."
Besides his current legal battle with his mother, Elijah was also recently denied a request to dismiss his divorce from his wife, Marienagela King. The reason seemed to have been based on a legal technicality as a temporary support order is in place, and the judge is denying the request due to the temporary order.
Elijah, who had filed for divorce from his wife in 2021, recently reunited with her amid his ongoing legal battle with his mother. The pair are now putting on a united front against Cher, with King even making an appearance in court for Elijah's latest hearing.
