Charlie Sheen's ex-wife, Brooke Mueller, has been ordered to submit to drug testing, and if she relapses on drugs and/or alcohol -- she will lose custody of her kids.
According to new legal documents obtained by The Blast, Sheen filed an "ex-parte" or emergency request to formalize an agreement the former couple made in August of 2023.
In the filing, Sheen asks Mueller to be closely monitored for drug and alcohol abuse, and if she tests "dirty" she should lose custody of their two children.
As you know, the famous ex-couple shares two kids, 14-year-old twins Bob Sheen and Max Sheen.
The 'Two And A Half Men' star filed the documents that included an agreement -- which was privately signed over the summer.
Charlie Sheen's Ex-Wife, Brooke Mueller, Allegedly Relapsed On 'Controlled Substances'
The agreement states the two boys will live with Charlie, but "Brooke shall enjoy reasonable and flexible periods of custody and visitation as agreed and arranged between the Parties, recognizing the goal of frequent and continuous contact between the minors and both parents."
But, it also says, "Brooke shall test for drugs and alcohol (1) as often as required by her probation officer; (2) within 24 hours of a written request (email or text) from Charlie or his attorney, until the Parties' children reach the age of majority or graduate high school, whichever is later; and (3) at a minimum of once per week regardless."
Adding, "Brooke's custody/visitation will be terminated immediately following any positive test."
As for the testing, the agreement says "In addition to an actual "dirty" test, a positive test shall include: A missed test will be considered a positive test -- or Discussing this issue with either of the Parties' Minor Children will be considered a positive test."
Shockingly, the filing includes this interesting stipulation. "Brooke shall forthwith provide to [Charlie's attorney] the names, addresses, and telephone numbers for all her regular, historic sources of controlled substances, to be held in confidence until and unless Brooke relapses."
It should be noted, that the document isn't clear on why Charlie is filing this agreement in the public divorce case. The emergency request simply asks "that the court sign and enter the accompanying stipulations and orders." In other words, making the agreement part of the official divorce case. It's unclear if Brooke Mueller is currently having issues.
However, it does clearly state that "In or about June and July 2023, Brooke relapsed and engaged in abusing alcohol and controlled substances."
Plus, it says that "sole legal custody and sole physical custody" will be given to Charlie, "in the event Brooke tested positive for drugs or alcohol, or otherwise relapsed with respect to the use of drugs or alcohol."
The good news is that "conditioned upon Brooke remaining clean and sober, Charlie will continue to pay Brooke's rent at her current residence."
In the end, the emergency request was heard in court on January 18, 2023, and the judge granted Charlie's request. Plus, the court signed the stipulations formalizing the agreement.
