Olivia Wilde & Jason Sudeikis' Ex-Nanny Demands Jury Trial, Claims She's Being Silenced

The former nanny of Hollywood stars Olivia Wilde and Jason Sudeikis has come forward to request a jury trial as her legal dispute with them shifts towards private arbitration.

Earlier this year, Ericka Genaro, who served as Wilde and Sudeikis' children's nanny from 2019, filed a lawsuit accusing them of wrongfully firing her, allegedly because she became anxious and depressed from working for them.

Wilde and Sudeikis, who share two children, son Otis and daughter Daisy, have been at the center of media attention since their high-profile split in 2020. While the public has been eager for insights into the intricacies of their separation, Genaro, who played a crucial role in their kids' lives, has spoken out after her case against them was moved away from the courtroom to arbitration.

According to US Weekly, the former nanny has reportedly expressed frustration over the lack of transparency in the legal proceedings, calling it an "error" for the court to make that ruling as she recently filed an appeal in California's 2nd District Court of Appeal.

The move towards private arbitration involves resolving disputes behind closed doors, away from the prying eyes of the media and the public. Genaro's attorney, Ron Zambrano, told the news outlet that they "disagree with the judge's decision" and will strive to "have the ruling reversed."

"We believe the judge did not apply the facts presented to applicable law, which should have led to a finding that the agreement was unenforceable," he shared.

"The evidence is insurmountable to support our claims, including text messages and testimony that she was driven to quit, then was summarily fired anyway. Ms. Wilde and Mr. Sudeikis want this case moved into arbitration to silence Ms. Genaro. We believe they should not be given special treatment merely because they are celebrities and should have to face their accuser in court," Zambrano added.

In February, Wilde and Sudeikis were sued by Genaro, who alleged that she was wrongfully fired on grounds of discrimination related to her mental health.

The former nanny claimed that her dismissal was not a result of job performance but rather a consequence of seeking support for her mental well-being after she "became increasingly anxious and stressed" because of their split, per US Weekly.

She made several revelations about the "Booksmart" director and "Ted Lasso" star's marriage, including that Wilde "abruptly" left their family home, with her absence causing an "adverse effect" on the house, leading to Sudeikis leaning on her for "support."

She claimed he asked her to "stay up at night after the kids were put to bed to talk" about his split from Wilde, which made her feel "compelled to engage" and created "extreme anxiety to her" because she thought she had to "pick sides" between the "parents of the children she was ostensibly the primary caretaker."

The exes took legal action in response to Genaro's lawsuit, challenging the nature of the lawsuit and invoking an arbitration clause. According to US Weekly, the former couple alleged that the case was improperly filed as a civil suit rather than as a hearing before the American Arbitration Association (AAA) in New York.

"It is unfortunate that this private matter continues to play out in the press. Our focus has been and will continue to be to steadfastly protect our family in the face of harassment of any kind," they told the news outlet in a joint statement. "We are confident that the evidence brought forward will affirm our position to dismiss this case and bring our family peace summarily."

In the motion to compel arbitration, they argued that the employment contract with Genaro "obligated" an explicit arbitration clause from her, specifying that any disputes between the parties should be resolved through arbitration with the AAA. They also alleged that many of Genaro's claims are without merit, as they "generously paid" her throughout her time as the kids' nanny.

Wilde and Sudeikis recently reached an agreement on their custody case. The former couple will share joint custody of their children on a "week-on, week-off basis."

In court documents obtained by the Daily Mail, Sudeikis is to pay $27,500 per month in child support, which comprises $10,300 for Otis and $17,200 for Daisy. He will also have to pay 25% of Wilde's childcare and monthly child support fees.

Per the documents, the amount was seemingly based on Sudeikis 2023 income estimate of $10.5 million, against Wilde's $500,000, although it noted that their income was "in dispute and fluctuates," but that "such disputes and fluctuations are not material to their agreement that Jason has an extraordinarily high income."

"The parties agree that child support for the minor children for $27,500 per month is sufficient to maintain the needs of the minor children considering Jason's station in life, is consistent with each child's best interest, and application of the guideline would be unjust or inappropriate in this case," the document stated.
