'RHOA' Star Kim Zolciak Slammed By Divorce Judge For Skipping Hearing

Kim Zolciak and Kroy Biermann's latest hearing in their divorce case was deemed a "waste" by the presiding judge after the "RHOA" star failed to appear for a hearing.
According to witnesses inside the courtroom, Biermann's lawyer pressed on about selling the former lovebirds' joint Georgia home. As you know, the argument comes just days after Zolciak had filed a motion to dismiss Biermann's second divorce filing. The former couple had previously announced their separation in May, but by July, they had "reconciled."
Kim Zolciak's Failure To Show Up For Divorce Hearing Angers Judge
During the hearing in Fulton County Superior Court, all parties except Zolciak were present. As explained by her lawyer, David Beaudry, the blonde beauty couldn't attend because she was returning from filming for the MTV reality series "The Surreal Life" in Colombia -- and was expected to land in Atlanta at around 9 p.m. local time.
Despite repeated apologies from Beaudry, the judge expressed irritation and firmly reiterated that she had not permitted the reality television star to skip the hearing.
"Her presence was not waived for today, so she is supposed to be here. I did not waive her presence," the judge said.
The tense exchange led the judge to temporarily pause proceedings, according to reports. Upon resuming, the judge, still visibly irritated, made the decision to reset the hearing and eliminate the option of appearing via Zoom. She insisted that going forward, all parties involved in the case would be required to physically appear in her courtroom.
Although Judge Williams' decision appeared to disappoint all participants, it didn't stop Biermann's lawyer, Marlys Bergstrom, from shifting focus to an emergency motion, requesting court permission to sell the family's $3 million home in Alpharetta, Georgia.
During this discussion, it was disclosed that Zolciak had refused to list the estate for sale, and it was now scheduled for foreclosure on November 7. Biermann then confirmed this information when he spoke for the first time during the hearing, saying, "Correct."
When the judge inquired if the "Real Housewives of Atlanta" alum's attorney was aware of the pending foreclosure, he responded, "No, judge, I did not know that." Meanwhile, when asked about the approximate equity in the home, Biermann declined to answer, citing concerns about media coverage of the hearing.
The former Atlanta Falcons linebacker had previously mentioned the foreclosure in legal documents when shooting down his estranged wife's request to dismiss his divorce filing. In the papers obtained by The Blast some days ago, he expressed:
"Petitioner has no desire to reconcile. The fact that he engaged in sexual relations with Respondent does not indicate a desire to reconcile. Petitioner, after this second filing, remains steadfast in his desire to divorce Respondent, and leave the marital residence, despite the fact that the home is currently in pre-foreclosure."
Biermann, who called Zolciak's initial petition a "legal game," added that "the filing of motion is just another delay tactic in Respondent [Zolciak]'s playbook as indicated by her exclamation "I'm living here not going anywhere!"
The Former Partners Are Embroiled In More Than One Legal Battle
Biermann and Zolciak's ongoing divorce proceedings recently took a noteworthy financial twist when Target National Bank filed a complaint alleging that the latter has neglected to pay $2,482.24 in credit card fees. As we reported, records indicated that the 45-year-old opened the card in December 2007 but stopped making payments in September 2022, even though there was a final payment of $500.
To attempt to resolve the issue, the financial institution has taken over the account and is actively pursuing debt collection. As of now, Zolciak has not responded to these claims, leaving it uncertain whether she intends to sort out the dispute in the near future.
With this latest problem, it seems that the financial challenges for the estranged couple are escalating, as they are confronted with a substantial debt to the IRS, totaling over $1 million. The jaw-dropping amount encompasses unpaid taxes, interest, and penalties from 2013, 2017, and 2018.
Additionally, Biermann has a lawsuit of his own from Sky Warrior, the credit line handler for the Baha Mar Casino in the Bahamas. According to legal documents, it's alleged that the Montana graduate obtained a $100,000 line of credit for his November 2021 casino trip, of which he used $52,500 for gambling.
