'RHOA' Star Kim Zolciak Files For Full Custody Of Her Children

'Housewives' star Kim Zolciak is asking a judge for full physical custody of her children, in the nasty divorce battle with ex-husband Kroy Biermann.

According to new legal documents, obtained by The Blast, Kim filed a response and "counterclaim" to Kroy's original divorce documents in Fulton County, Georgia claiming she should get primary physical custody of the former couple's four minor children.

In the filing, Zolciak says the couple separated on April 30, 2023, but the kids have been living with both parties at the marital residence. Plus, prior to the breakup, the kids have lived with both parents since birth. In other words, Kim writes she is a "loving, fit, and proper parent to have joint legal and primary physical custody" of the children.

Zolciak says Kroy should have "liberal visitation" with the kids.

It should be noted, "legal custody" normally constitutes sharing the right with your ex-spouse to make major decisions like schooling, religion, and medical issues. The documents reveal Zolciak wants Kroy to pay "temporary and permanent child support" along with "temporary and permanent alimony" following the split.

As we reported, Kroy filed for divorce several weeks ago, claiming the kids are currently in his care -- and he should have sole custody of the children.

As for the rest of the couple's money, Kim is asking a judge to order Biermann to split everything, writing, she should be "awarded an equitable division of all marital assets and debts accumulated during the marriage." The other problem with that statement is that they reportedly owe the IRS $1 Million.

Also, Kim wants her share of the ex-couples high-end items from the house, asking a judge he be "restrained and enjoined from removing or secreting any property of the parties, including any bank accounts, retirement accounts, furniture, and household goods in the marital residence."

Interestingly, the reality star is asking the court to legally change her name back to "Kimberleigh Marie Zolciak." Of course, she has always gone by that name on the television show and in the public's eyes.

The bottom line, this divorce is nasty and both of them are slinging mud at each other like a good reality show.

In Kroy's original divorce documents, he claims Zolciak is an addicted gambler and it has thrown the family into financial disaster. Biermann says the situation is so bad, she can't take care of the kids and the "compulsion" is "very troubling behavior." Shockingly, he is asking the court to run a psychological evaluation on his ex-wife claiming the gambling "may be the result of underlying mental health issues like depression, anxiety, narcissistic personality disorder, bipolar disorder or ADHD."

Of course, Kim responded with her own allegations of bad parenting. Zolciak claims she has serious concerns for the safety of her children because Biermann is smoking a large amount of marijuana. In court documents, Kim is asking a judge to forcer Kory to submit to drug testing -- including a hair follicle test. The best part is she doesn't want him to be about to "cut or remove" any of his hair to hide the weed smoking.

In most celebrity cases, these divorce cases will be settled out of court. As of now, there are TWO divorce cases and they are fighting over who has to pay for the lawyers.
