'Rehab Addict' Star Nicole Curtis’ Baby Daddy Accuses Her of Using Son to Stay Relevant

"Rehab Addict" star Nicole Curtis is accused of breaching her custody settlement with her ex only months after signing on the dotted line, and her baby daddy wants the court to gag the reality star.
According to court documents obtained by The Blast, Shane Maguire claims that following the custody deal they reached in late October, Curtis' "contemptible behavior and inappropriate antics have continued.”
He says earlier this month, Curtis emailed him an hour before leaving to Mexico with their son, without ever having informed him or providing him with the itinerary … as required per their deal.
Further, he takes issue with an Instagram post she made on Thanksgiving that claimed he refused to let her spend time with their son on the holiday. He points out that he was awarded Thanksgiving Day, per their deal, and Curtis knew this.
Curtis claimed their son was sick and their kid was "ripped out of my arms and whisked away." Maguire says this is false and this is not the first time she has claimed their kid was sick and used it as an "excuse to thwart Plaintiff Father’s parenting time, only to have the child show up completely fine and showing no symptoms of illness."
He says Curtis clearly has no plans to follow the custody deal unless it suits her and will continue to try the case in the court of public opinion.
Maguire says he fears Curtis will screw up his time with their son on Christmas, claiming she already told him she can’t find a flight from Los Angeles to Minnesota that would work.
He is pleading for the court to step in and force Curtis to follow their deal and to issue a gag order against her.
Maguire describes Curtis as “a former reality television personality" who has "continued to post disparaging and false comment" about him and his parenting of their son on her social media accounts. He accuses her of using their son as a "publicity opportunity to stay relevant in the entertainment industry.”
Maguire wants the judge to ban Curtis from talking publicly about their son or the legal battle.
Nicole Curtis has yet to respond.
Back in October, Curtis and Maguire reached a settlement over custody that prevented them from having to battle it out in a scheduled court trial.
The agreement states the two will now share joint physical and legal custody of their three-year-old son, Harper.
Curtis and Maguire agreed not to trash talk the other to their son or attempt to alienate the minor child from the other. The deal also says neither side will put their son on medication for longer than 30 days without consent.
Previously, Maguire expressed that he planned to move to California to be closer to his son but feared if he did, Curtis would pack up and leave the state with their kid. As part of the settlement, they agreed that neither will move and there would be a penalty if either tried to change it.
The deal has neither side paying child support, which means Curtis agreed to cut the $1,200 a month she was receiving previously.
Earlier this year, Maguire filed a request for custody in the ongoing custody battle with Nicole Curtis. He claimed Curtis has been “incapable of facilitating” the relationship between Maguire and their son.
Maguire claimed the HGTV star was trying to “ruin their relationship entirely” by making custodial handoffs a “game of cat and mouse.”
Because of her alleged actions, Maguire claimed Curtis was “not a fit and proper person to share legal or physical custody of the minor.”
Curtis denied his allegations and demanded he not be granted his motion to strip her of custody.
She accused Maguire of resorting to “the heavy-handed and headline-attracting maneuver of seeking a change of legal and physical custody”
Back in 2016, the court entered a final judgment in their case that covered custody, support and other issues.
