“Real Housewives of Beverly Hills” star Erika Jayne‘s estranged husband Thomas Girardi has been placed under a temporary conservatorship.
According to court documents obtained by The Blast, a Los Angeles Superior Judge granted a petition filed by Thomas’s brother. Robert Girardi will now be the temporary conservator over the famed attorney.
The court minute order states Thomas didn’t show up to the hearing because he has medical issues. It read, “The Court finds that the Proposed Temporary Conservatee is not attending the hearing because of medical inability.”
The judge is allowing Robert to be the conservator until March 30th.
Thomas’s court-appointed lawyer wrote a report to the judge. He detailed a recent conversation with the once-respected lawyer. He says it is his conclusion, “that Thomas could not fully comprehend the nature of the proceedings although he did state that he had no objections to Robert taking care of him the limited purpose of executing contracts on his behalf. Thomas voiced his concern of having a media circus at the hearing.”
He revealed, “He indicated that he wanted to continue the matter for thirty days as 10
identified the petitioner and reviewed the petition with him.” Further, he claims Thomas “informed him of the he was currently having tests performed to diagnose any memory issues. ”

As The Blast first reported, last month, Robert Girardi filed a petition to become Thomas’s conservator. In the documents, Robert claimed his brother was unable to take care of himself and was suffering from short-term memory loss.
The documents read, “Thomas V. Girardi (“Tom”) is a renowned trial lawyer, responsible for some of the most notable mass tort verdicts in California. However, at age 81, Tom’s current condition has sadly deteriorated to the point where he cannot care for himself without assistance. His short-term memory is severely compromised and, on information and belief, he is often not oriented as to date, time or place.”
He said he “has first-hand knowledge that Tom lives alone and can not care for himself.” Robert said
“For at least 25 years, Tom has employed help to assist him with day-to-day functions,” Robert wrote. He claimed his brother was without help and his longtime housekeeper was on the verge of quitting because she wasn’t being paid.
Many of Thomas’s creditors have questioned the memory loss and find it conveniently timed given his legal woes.
Earlier this year, Erika filed for divorce from Thomas after 21 years of marriage. She is demanding spousal support. He is fighting the request.
As The Blast first reported, Erika has been shacked up in a $1.5 million home near Hollywood. She moved out of the $15-million mansion she shared with Thomas. The two are still facing a federal lawsuit accusing them of embezzlement.
In the lawsuit, Thomas is accused of ripping off his former clients. He represented the family members of plane crash victims. They won a settlement from a wrongful death lawsuit Thomas brought for them. However, they claim he didn’t pay them the entire settlement. The suit claimed he diverted the money to help fund his lavish lifestyle with Erika.
The documents stated, “Girardi continues to embezzle funds owed to clients into his own personal and firm bank accounts. In turn, he continues to use that money to fund his and Erika’s lavish lifestyle, release personal guarantees, pay down loans, route the money to friends and family …”
The case is ongoing. Thomas has yet to respond.
