We're told Ricci told investigators her husband had been 'verbally abusive' and she needed an emergency restraining order because she was in 'fear of her husband.'
As we reported, the LAPD issued an emergency protective order which says James now has to stay 100 yards away from the actress, after she reported the alleged assault.
Now, our sources say, the EPO also ordered Heerdegen to immediately move out of the couple's Los Angeles home. The emergency order expires on Thursday, and if Ricci wants it extended -- she will have to file a domestic violence restraining order in the Los Angeles County Courts.

On Wednesday, the LAPD confirmed they received a 'domestic battery' call from the actresses home over the weekend but said no one was arrested on the call.
Plus, we're told the officers indicated in their report that there were NO serious injuries or marks on the actress when they arrived. But, for the record, a person CAN be charged with Battery for spitting on someone.
At this point, we're told Ricci has already hired a divorce attorney and plans on ending the couple's 7-year marriage in the coming days.
The domestic battery case is still under investigation.
The couple met on the set of the television show 'Pan Am' in 2011. James Heerdegen is also in the television and movie business and works as a 'dolly grip.' The job involves a camera dolly (the wheeled cart structure that the camera sits on) and the person who is responsible for operating it.
Just a few weeks ago, the actress did say nice things about her husband on Father's day posting a message on Instagram, saying, “We ♥️you, Daddy!"
As for next steps, we're told Ricci is preparing to file for divorce, and so far James has not responded to the allegations.
