"My Unorthodox Life" star Julia Haart was recently refused a protection order against her husband, Silvio Scaglia. The duo reportedly got married in 2019; however, the mother of four filed for divorce from the Italian billionaire early this year.

Months after the divorce filing, the tv personality sued Scaglia for allegedly owing her millions of dollars for her shares and efforts in the modeling company, Elite World Group. Haart's most recent case against the 63-year-old accused him of threatening to kill her and being aggressive towards her and her children.

The former CEO filed for an order of protection against the businessman; however, it got rejected by the court. The presiding judge found irregularities between the evidence provided and the testimonies of Haart and her daughter, Miriam, and ruled against it. She was, however, given exclusive use of the couple's million-dollar penthouse in Tribeca.

A Judge Rejected Julia Haart's Protection Order

As per Page Six, a judge recently ruled against Heart's claim that her estranged husband, Scaglia, abused her. The television personality is currently in a bitter divorce with the Italian billionaire after filing for the dissolution of their marriage in February. She recently asked the court for an order of protection against him.

Her reasons were because Scaglia allegedly terrorized her in their $65 million property in Tribeca and left her in tears. The reality star also claimed that the technological entrepreneur made anti-semitic slurs and behaved rudely to her children.

Despite the number of accusations, the presiding judge, Judge Douglas Hoffman, ruled against the protection order. He said, "There was no fear exhibited by either party and no intimidation, certainly not of Wife."

Julia Haart Was Given Exclusive Use Of The Penthouse

According to the ruling documents provided by Page Six, the judge claimed that the duo merely exchanged words and that the accused billionaire did not physically or emotionally harm the 51-year-old.

The document read, "The court does not find that Mr. Scaglia exerted physical or emotional control over Ms. Haart. Each party strongly and ably argued with the other, and there was not a credible showing of any physical or emotional intimidation."

The judge also revealed that there was no indication that either party involved had enough physical, emotional, and psychological control over each other to be able to cause enough damage that could be described as a family offense.

Despite the ruling, Judge Douglas allowed Haart to hold on to the couple's $65 million penthouse exclusively for an unidentified period. The tv personality's attorney, Michael F. Beyda, said, "Silvio saying that he would kill Julia in the press was not sufficient for a criminal restraining order. But Judge Hoffman did grant Ms. Haart the relief she was seeking, which was exclusive use and occupancy."

Haart accused her estranged husband early this year of saying he would kill her. Scaglia also got accused of being hostile towards her son's religion, Judaism. The court petition was filed a day after the 51-year-old was fired from her position as the Elite World Group CEO. She claimed the order would prevent the 63-year-old from carrying out his alleged threat.

According to Haart, the billionaire said, "I will kill you in the public eye." In the petition, she said she was scared for her safety and her children's well-being. Scaglia was also described as turning "increasingly volatile, abusive and unhinged" in the document.

To support her claim, the tv personality's daughter, Miriam Haart, revealed that she was at the scene at the time of the incident and claimed her mother was on the bathroom floor, naked and crying hysterically. She said that she worried about her mother's safety because Scaglia was screaming in the background and acting aggressively.

The Testimonies Were  Allegedly Not Credible

Despite the claims of Haart and her daughter, the court revealed that they found the testimony not credible. The presiding judge went through several pages of WhatsApp messages between the former couple and listened to their voice recordings.

This evidence (Via Page Six) not only negated the claim that Scaglia wanted nothing to do with her children but also revealed that the 63-year-old was affectionate towards them when he got married to the reality TV star. The filing read, "The WhatsApp messages during the pertinent time frame directly contradict this testimony. The messages are replete with mutual expressions of love and affection."

Judge Douglas further concluded that Haart filed the petition because she got fired from her position as CEO. The move to publicize her allegations was allegedly to gain exclusive rights to the house she previously lived in with the billionaire.

Robert Wallack, Scaglia's attorney, described the court's ruling as a "resounding and complete victory" for his client. "All of Julia Haart's false allegations of abuse were rejected by the Court, and both Ms. Haart and her daughter Miriam were found to be not credible."
