Sofia Vergara Wants To Grill Ex-Fiancé Nick Loeb Under Oath In Court Battle Over Frozen Embryos

“Modern Family” star Sofia Vergara is back in court battling her ex-fiancé Nick Loeb over their frozen embryos, demanding he sit for a deposition.
According to court documents obtained by The Blast, Vergara is asking a judge to order her ex to sit for a depo immediately. She claims to have put him on notice multiple times, but he has blown off the scheduled sit-downs.
Loeb allegedly demanded the depo take place in New York, which Vergara believes is absurd since he doesn’t live there. Vergara wanted Loeb to be grilled on November 15 in Los Angeles, where he failed to appear.

Vergara and Loeb have been fighting in court for years over the embryos. They ended their relationship before bringing any embryos to life. After their split, Loeb filed multiple lawsuits against the actress demanding he be allowed to use the embryos. She has been fighting him over the contract, which states both need to consent to bring to term.
She is suing her ex and The ART Reproductive Center, where the embryos are stored, demanding the court order the embryos can’t be brought to life without her consent.

In newly filed documents, Vergara says Loeb recently tried to depose her in the case. She says he should not be allowed to until he sits down for one. She says the trial is set to start on June 15, 2020 and needs his testimony to build her case against him.
A judge has yet to rule.
Back in November, Loeb suffered a huge setback with his last lawsuit thrown out of court. A Louisiana judge scolded him for bringing a lawsuit against Vergara in the state.
The court order read, “Since the pre-embryos in this case are not and never were in a Louisiana facility, Louisiana’s Human Embryo Statue does not apply to them, and they cannot be considered proper party plaintiffs in this case.”
Despite the drama, Vergara has good news with her being considered as a replacement judge for "America's Got Talent."
