“Real Housewives of Orange County” star Gina Kirschenheiter is headed back to divorce court to battle her ex-husband Matt Kirschenheiter over having to be grilled under oath about alleged domestic violence.
According to court documents obtained by The Blast, the reality star and her ex are scheduled to appear in Orange County court this week. A judge is set to hear arguments from both sides regarding Matt’s recent motion to compel.
In his motion, Matt is demanding Gina be ordered to sit for a deposition. He wants to ask her about her domestic violence allegations against him. He says Gina has refused to be deposed in their battle. He claims his ex-wife will only agree to discuss financial matters and not the abuse allegations.
Matt believes she should have to turn over financial information including her “Real Housewives of Orange County” salary. He wants the judge to sanction Gina to the tune of $5,444.71 for refusing the deposition topics.
Back in 2018, Gina filed for divorce from Matt following eight years of marriage. In her petition, she listed the date of marriage as May 15, 2010 and the separation date as March 3, 2018. The two share three minor children.
The two reconciled numerous times while trying to work out their issues but the divorce continued on.
During the divorce battle, Matt was arrested for domestic violence relating to an incident with Gina. He would be charged with felony “corporal injury – on spouse/cohabitant” and felony “False imprisonment effected by violence, menace, fraud, or deceit.”
He pleaded not guilty to the charges and is awaiting trial. He is facing 4 years in prison for the domestic violence charge and another 3 years on the false imprisonment charge. Gina took out a restraining order against Matt following the incident.
Despite the legal issues, the two reached a divorce settlement which has Matt paying $10,000 in child support. Gina has primary custody of the kids with Matt having visitation.
Matt rushed to court following the deal demanding the support be slashed. He believes Gina should pay him support for their kids. A judge will make a decision following this week’s hearing.
