'All Rise'star Lindsay Mendez is asking a judge to give her full custody of her daughter, claiming her ex-husband threatened murder-suicide.

According to new legal documents, obtained by The Blast, Lindsay filed an emergency domestic violence restraining order, asking to give her full custody claiming she is worried about the safety of herself and her child.

In the filing, the 'Wicked' star says her ex-husband Philip Wakefield made a comment to a mutual friend during a birthday party for their daughter. "My requests are based upon Respondent Philip Wakefield’s (“Philip”) disturbing and frightening behavior which culminated in his recent comment to my friend, during our daughter’s first birthday party “Well, I go between being okay and thinking a lot about murder-suicide” in response to her asking him how he was doing in light of our dissolution proceeding," she wrote.

Adding, "I presently have physical custody of Lucy and worry that he would somehow try to harm one or both of us as a result of my seeking court protection. Based on Philip’s bizarre, unstable and threatening conduct, I believe he poses an imminent risk of harm to our daughter’s physical and emotional safety."

We broke the story, Mendez filed to end her 5-year marriage in January of this year. At the time, she said the couple had separated two days before Christmas on December 23, 2021. From the start, Lindsay is pushing the court to give her full physical custody of the child.

Unfortunately, things turned ugly after the Broadway star made several allegations of domestic abuse in the relationship. It should be noted, the murder-suicide allegation was reported to the couple's therapist by the friend -- and according to the documents -- he admitted to making the comment in a voicemail to the same friend, but said it was a joke.

In the filing, a transcription of the call claims he said, "I just wanted to call and tell you that um you know I appreciate your concern and wanted you to know that ah what I said at the Zoo was a joke and um I’m not mad about you bringing it up um you know with the therapist and it’s you know obviously like no harm no foul um but I just wanted to call you and let you know that it’s like sort of tongue and cheek um just about horrible divorce is and maybe you know it’s not something I should joke about, aah with the whole murder-suicide thing but it was a joke and I’m not having suicidal ideation at all really and there is zero chance that I’m going to murder anybody, so it was a joke and I’m not mad and I appreciate you um you know in general."

Lindsay alleges this isn't the first time the couple has had violent incidents during their marriage. In the documents, the Broadway star says on one occasion a nasty argument culminated in her locking herself in a bedroom. She claims her ex-husband broke the lock and handle off of the door while attempting to make entry into the room. "Philip, without even asking me to first to open the door and let him in, broke the locked door handle off and was then able to push the door open,' she wrote. Now, she is asking a judge to consider the situation and order her full custody. She says, "Because of Philip’s recent comment about his thinking about a murder-suicide, I have canceled his visits with Lucy which were to take place this week until I am able to obtain orders to suspend Philip’s visits pending the granting of the other relief requested to protect Lucy from what I believe is imminent harm...Philip’s abusive and erratic behavior, coupled with his statement that he has suicidal and murderous thoughts cause me serious concerns about his mental health, his impulse control, his ability to control his anger, his aggression."

Adding, "I have been in essence walking on eggshells around Philip since I filed for dissolution thinking that I can get through this on my own without further angering Philip. I now realize I cannot manage this on my own and that Philip’s conduct appears to be getting worse, not better. It is for this reason that I am filing for Domestic Violence Restraining Orders."

A judge in the case DENIED the emergency restraining order, opting to order the ex-couple back to court to argue their positions. The hearing is on May 17th.
