According to court documents obtained by The Blast, an involuntary bankruptcy petition was filed by people who are owed money from Erika’s lawyer husband. The case was filed in Federal Court in California.
The documents state, “The debtor is generally not paying such debtor’s debts as they become due.” The creditors include his former law partners, Robert Keese and Jill O’Callahan. Jill says she is owed $757,000 and Robert believes Thomas owes him over $1,5 million.
A [family member](https://pagesix.com/2020/12/19/erika-jayne-reveals-california-judge-is-tom-girardis-alleged-mistress/0 of one of his former clients is also listed as a creditor on the petition. The court will determine if the involuntary bankruptcy is approved. If so, Thomas will have to deal with all of his legal battles in one place.
The court will appoint a trustee to be in charge of all negotiations with his creditors and to determine Thomas’s assets to sell off to pay back his debt.
The bankruptcy is the latest in a string of financial woes for the once prominent lawyer.
Last month, Thomas and Erika were hit with a federal lawsuit accusing them of embezzling millions owed to his clients. The plaintiffs believe the duo used the money to fund their lavish lifestyle.
The suit read, “Tom has resorted to embezzling the proceeds of settlements that should have been directed to his clients—including, as the basis for this Complaint, the widows and orphans who lost loved ones in the tragic crash of Lion Air Flight 610—in order to continue funding his and Erika’s lavish Beverly Hills lifestyles.”
At a recent hearing in the case. the judge was angry that Thomas was unable to explain where millions of his client’s money went. He found the lawyer in contempt of court and referred the matter for a possible criminal investigation.
Thomas’s lawyers are playing the senile old man card and asking for a mental exam. Erika has remained mum about the claims she helped her husband steal money. Instead, she has decided to post a bunch of topless photos on her Instagram.
Earlier this year, the “Real Housewives of Beverly Hills” star filed for divorce from Thomas after 21 years of marriage. She is currently asking the court to award her spousal support, which could be affected by the bankruptcy and the various creditors trying to get paid their money.
Thomas responded to the divorce by demanding Erika be denied support. The plaintiffs suing the couple believe the divorce is a “sham” meant to hide assets from Thomas’s creditors. Erika reportedly received over $20 million from Thomas paid into her entertainment company.
