According to court documents obtained by The Blast, Thomas’s firm partner, Robert Keese, is suing Erika’s husband in Los Angeles Superior Court.
Robert accuses Thomas of breach of contract and conversion. In the suit, Robert says he practiced the law with Thomas for over 30 years. He says he retired from law over 10 years ago.
At the time of his retirement, Robert entered into an agreement where Thomas would pay him a monthly income for ten years. In exchange, Thomas was able to continue using Robert’s name on the law firm.
At the end of the 10-year period, Thomas agreed to make bi-monthly payments of $8,133.33 to Robert from retained earnings in the sum of $554,000 that Thomas held in a trust for Robert.
Robert says Thomas made the first couple of payments on the $554,000 but then stopped. He says he is still owed $506, 876.
He says “Girardi took money that did not belong to him for his own personal use. Girardi’s conversion of money belonging to Keese was done by Girardi without Keese’s consent. This conversion by Girardi was intentional. ” Robert wants Thomas to pay up on the $504,000 owed plus interest.
As The Blast previously reported, the lawsuit is the latest in a string of legal issues for Thomas. Last month, Erika and Thomas were sued for allegedly embezzling settlement funds meant for plane crash victims’ families.
The federal lawsuit was brought by the class-action law firm Edelson PC, who is representing a bunch of Boeing plane crash victims who won a settlement while being represented by Thomas.
The plaintiffs say they did not receive the full payment and believe Thomas sent the money to Erika’s company to keep it from the families. Erika was added as a defendant in the lawsuit. They believe Thomas sent the money to Erika to fund their lavish lifestyles.
The court documents read, “Tom has resorted to embezzling the proceeds of settlements that should have been directed to his clients—including, as the basis for this Complaint, the widows and orphans who lost loved ones in the tragic crash of Lion Air Flight 610—in order to continue funding his and Erika’s lavish Beverly Hills lifestyles.”
Erika and Thomas have yet to respond to the lawsuit.
After being hit with the massive suit, Thomas was hit with a separate $800,000 lawsuit accusing him of owing a bunch of money.
Thomas and his law firm Girardi Keese were served legal papers by Wells Fargo Vendor Financial Services. Wells Fargo accuses Thomas of breach of written agreement and conversion. The suit says Erika’s estranged husband’s law firm entered into a lease agreement where they agreed to finance the lease of certain office equipment. They say Thomas stopped making payments and owes them $882,715.51 immediately. Wells Fargo wants to seize all of the equipment from Thomas’s offices ASAP.
