'RHOBH' Erika Jayne & Husband Sued For Allegedly Embezzling Money In Divorce

By Ryan Naumann

"Real Housewives of Beverly Hills" star Erika Jayne and her estranged husband Thomas Girardi are being accused of embezzling money in a sham divorce.

According to court documents obtained by Page Six, The class-action firm, Edelson PC, filed a federal complaint against the reality star and her lawyer husband. In the suit, the firm says they represent a bunch of Boeing plane crash victims who believe settlement funds received by Thomas were embezzled and used to fund his lavish lifestyle.

The lawsuit claims Thomas and his law firm Girardi Keese “are on the verge of financial collapse and locked in a downward spiral of mounting debts and dwindling funds” and his “need to fund outrageous lifestyles for himself and his soon-to-be ex-wife Erika Jayne” is the reason for their divorce.

“While Erika publicly filed for divorce this month, on information and belief, that ‘divorce’ is simply a sham attempt to fraudulently protect Tom’s and Erika’s money from those that seek to collect on debts owed by Tom and his law firm GK,” reads the suit.

The suit accuses Thomas of a pattern of keeping money meant for his clients. The suit stated Thomas, “continues to use that money to find his and Erika’s lavish lifestyle, release personal guarantees, pay down loans, route the money to friends and family and satisfy other outstanding debts.”

The law firm pointed out Erika's pop song talked about spending $40,000 to maintain her glam team. They cite that as an example of why they would embezzle money. Erika has yet to comment on the suit.

As The Blast previously reported, earlier this year, Erika filed for divorce from Thomas following 21 years of marriage. Erika listed the date of their marriage as January 7, 2000. She said the date of separation is To Be Determined.

Erika is also requesting Thomas cover her attorney’s fees in the case. She checked the box noting she is unaware of the full value of their assets .“The true nature and extent of the parties’ separate property and debts is unknown to Petitioner at this time,” Erika noted in her filing.

After filing her divorce, Erika released a statement that read, "After much consideration, I have decided to end my marriage to Tom Girardi. This is not a step taken lightly or easily. I have great love and respect for Tom and for our years and the lives we built together."

She added, "It is my absolute wish to proceed through this process with respect and with the privacy that both Tom and I deserved. I request others to give us that privacy as well."
