"Real Housewives of Atlanta" star Cynthia Bailey is suing her ex-husband Peter Thomas over an allegedly unpaid loan and she wants the court to seize his home.

According to court documents obtained by The Blast, on September 1, Cynthia filed a lawsuit against Peter in Georgia Court.

In the docs, Cynthia says she loaned Peter $170,000 for the purchase of an Atlanta property. In return, she agreed to hand over all rights and interest in Peter's restaurant Bar One.

Per their deal, Peter agreed to pay back the loan within 36 months.

Cynthia says the 36 months have passed by and she hasn't been paid a dime. The "Real Housewives of Atlanta" star says Peter has taken possession of the property despite failing to repay the loan.

She says in court documents that the, "Defendant has breached the parties Agreement and is in default under the Promissory Note and owes the Plaintiff One Hundred and Seventy Thousand ($170,000.00) Dollars in principal, plus interests from May 27, 2020 until the note is paid."

Cynthia is asking the court for permission to foreclose on Peter's home to collect on the money she is owed. The docs state, "Plaintiff elects to foreclose the Security Deed as a mortgage on the real estate property."

Further, she explains she wants him to cough up extra money for her having to take this to court. She says, "Plaintiff has had to retain legal counsel and incur substantial costs of litigation and requests attorney fees and other costs of collection.

The suit is asking the court to award Cynthia $170,000 plus seize the home from Peter immediately. Peter has yet to respond to the lawsuit. Cynthia informed the court they can serve him with the legal papers at his bar in North Carolina.

Back in 2017, Cynthia and Peter finalized their nasty divorce after years of being together. He faced allegations of infidelity for some time. Prior to their marriage, they signed a prenuptial agreement that determined who got what in the event of a split.

According to divorce documents, Cynthia was awarded her impressive collection of properties, including three homes in Georgia and one in Texas. She also got her Land Rover and Pontiac Montana.

Peter was able to keep his member interest in two restaurants, and his own company.

Earlier this year, Cynthia got remarried when she walked down the aisle with long-time fiancé Mike Hill. She looked incredibly happy while celebrating with her "Real Housewives of Atlanta" costars. However, her bachelorette party is where the real fun went down.
